Trump: It's my decision when to reopen U.S. economy

WASHINGTON (Reuters) - President Donald Trump said on Monday it was his decision when to reopen the U.S. economy, not that of state governors, but legal experts disagree and governors are going their own way.

Trump last month extended federal "stay at home" guidelines through April and has made clear he wanted the economy to reopen as soon as possible after the coronavirus outbreak that has killed nearly 22,000 Americans and cost millions of jobs.

However, he also has said he would listen to U.S. health experts and others in making any recommendations.

"It is the decision of the President, and for many good reasons. With that being said, the Administration and I are working closely with the Governors, and this will continue. A decision by me, in conjunction with the Governors and input from others, will be made shortly!" Trump wrote on Twitter.

The Republican president accused news media of incorrectly saying it was the governors' decision.

However, legal analysts say a U.S. president has quite limited power to order citizens back to their places of employment, or cities to reopen government buildings, transportation, or local businesses.

While federal health officials have issued anti-coronavirus guidelines including social distancing and wearing face coverings, Washington has not issued nationwide recommendations on school closings or shuttering public services and businesses, leaving individual states to make those determinations.

A number of states have extended their stay-at-home and social distancing orders beyond May 1, with Virginia's governor targeting June 10.

"All these executive orders are state executive orders and so, therefore, it would be up to the state and the governor to undo a lot of that, said Chris Sununu, the Republican governor of New Hampshire.

New York Governor Andrew Cuomo, whose state has been hardest hit by the new coronavirus, said Monday he would coordinate his response with governors of neighboring states.

"So, we'll listen to the experts, we'll follow the data but remember this is a delicate balance," he told reporters.

Each governor needs to make the best decision for their state and help people tap federal government benefits, including unemployment insurance, Sununu said in an interview with CNN.

"It's a pandemic. It has no playbook," Sununu said.

But there is the U.S. Constitution.

Under the 10th Amendment, state governments have power to police citizens and regulate public welfare.

"This is Federalism 101," said Robert Chesney, a professor of national security law at the University of Texas. "The president can advocate to his heart’s content, but he can’t actually commandeer the state governments to make them change their policies. He has no such inherent authority, nor is there any federal statute that purports to give him such authority."

I don't know all the laws, but it seems Trump wants us to believe his word is gold so that when he gives a date in the very near future we will think that's the day the economy suddenly is firing on all cylinders again and the market can run. If we were to think it's actually the State government that makes the call, then the date he gives doesn't mean much. I doubt he wants to lose that kind of control. But, if anyone who knows the laws better wants to tell me what's up, please do.

When it comes to being held responsible, that's when Trump claims it's just a "back-up" but when there's a possibility for him to claim credit for bringing the economy back, suddenly it's all about him.

It has nothing to do with liberalism or socialism. More like autocracy. It's another example of Trump thinking he has absolute power. Funny how he said it was up to the individual states when it came to issuing lockdown, but when it comes to removing those orders, suddenly he's the one and not the states. It just shows that he cares more about the economy (and wanting to be credited with growing it, but no responsibility for slowing it) than he cares about the safety of the public.
  actually is DOES have to do with liberalism and socialism if we are talking about economic liberalism.  If Libertarians are viewed as socially liberal and economically conservative, with a true focus on limited government, image if we have a President (we do) that is economically liberal and socially conservative .  The GOP used to be the party of smaller government with fiscal prudent while maintaining a conservative social agenda.  THIS President takes a socially conservative agenda (Reps) and applies an economically liberal (Dems) agenda.  He is for large government with government control over the people while acting in absolute terms.  This is the true dismantling of the of the Constitution.  The American experiment has failed.
It should be a slow gradual increase, less effected areas first. Itd be a disaster to open NYC lr major cities right away.

Doesnt seem to me you are at work and working. Does your employer pay you to sit in chat room and comment on investing sites? Seems to me you should be working doing work if someone is paying you to do it. Plenty of people right now would line right up to do whatever it is you claim to do ... and for less pay.
I work for myself so I can freely do what I want with my employee time but nice try.
  All unemployed people also technically work for themselves.  You said you are paying for someone else to sit.  You are not paying for ANYONE else.  Get off your high horse.  We had exceptional unemployment because people wanted to work.  You act like people are lining up to not work and default on their bill.  That's just plain arrogant and naive.  Enjoy your slacking off time.
