In the less likely scenario that the deal is canceled, Intel would be required to pay Tower a $353 million fine

What makes you think this is the less likely scenario LOL. The SAMR is behind the curtains going for some hefty remedies in case they accept and some of those remedies are by current american laws on very thin ice. Given the current general clinch between US and CN, chances that the deal gets accepted are rather unlikely than likely to happen. Intel would have to bend down very very deep to get an approval, an approval that would pretty much go against the chips act etc. Pat flying over is just showing how desperate this situation is. Currently the SAMR took the deal on hold (without time penalities on regular expiration times), which is technically a good sign, but if Intel simply can not because they are obliged by US law then gn8. simple as that.
